Certificates

Pursuant to Law 183/2011, certificates may not be submitted to public administration bodies or to private providers of public services.

In particular, it is provided that "Certificates issued by the public administration concerning statuses, personal qualities and facts are valid and usable only in relations between private parties. In relations with public administration bodies and providers of public services, certificates and affidavits are always replaced by the declarations referred to in articles 46 and 47 of Presidential Decree 445/2000" (self-certifications).
On certificates to be submitted to private parties, the following wording shall be affixed, under penalty of nullity: "This certificate may not be submitted to public administration bodies or to private providers of public services".

The Polytechnic University of Bari will issue exclusively stamped certificates, valid and usable (except for certain cases expressly indicated by the legislation). The current legal value is € 16.

All Public Administrations and private providers of public services are required to accept self-certifications, under penalty of violation of official duties. They are divided into:

  • Substitute declarations of certification (art. 46 Presidential Decree 445/2000), relating to statuses, personal qualities and facts expressly provided for by law;
  • Substitute declarations in lieu of affidavit (art. 47 Presidential Decree 445/2000): relating to statuses, personal qualities and facts, including those concerning other persons, of which the interested party has direct knowledge and which do not fall among those covered by art. 46.

Self-certifications entail the direct responsibility of the declarant regarding the content of the declarations and are subject to truthfulness checks by Public Administrations.

Self-certification also for private parties

Decree-Law no. 76 of 16 July 2020 containing “urgent measures for simplification and digital innovation”, converted with amendments into Law no. 120 of 11 September 2020, introduced an amendment to Presidential Decree 445/2000 (art. 30bis).
In light of this, from 15/09/2020 private parties ARE REQUIRED to accept self-certification or the substitute declaration.
Therefore, there is no longer any need to request certificates, which require payment of the cost of €35,50 (certificate cost €3,50 + two revenue stamps of €16, one for the request and one for the certificate), as a self-certification or a substitute declaration of certification may also be submitted to private parties.
